I had an inquiry recently from a reader of my post at TortsProf about a suit against Magic Springs brought by a woman who fell from their Zamperla spinning coaster. She was a rather large woman and was allowed to ride in two seats (!), apparently without restraints (!!).
In any event, there are no huge new updates but I thought I’d post what I downloaded in order to answer the inquiry, which is the complaint and current docket.

Fellner v. Holiday World Case Settles · 541 days ago
Two recent additions to the docket confirm it – here and here (both PDFs). No terms of settlement are noted in the docket, nor does there appear to be any press coverage of the settlement.
Recent briefs had indicated that the defendants stated unequivocally that no settlement would occur – indeed, they requested that no settlement conference take place. The Southern District of Indiana, however, requires such a conference, and one took place.
I’m personally glad that the case is completed, and I hope that all involved—Ms. Fellner’s family, and the Holiday World family—can get some resolution in their hearts and minds. This was a tragedy for everybody involved. The tort system is rarely a good way to deal with such tragedy, but I hope this was an exception.
